2. Ordering and Payment

2.1 Order Placement

When placing an order, you agree to:

• Provide accurate and complete information, including your name, email and contact details
• Specify all order details, including product type, size, flavours, decorations, and any special requirements
• Confirm your order details before final submission
• Ensure you are available to pick up the order on the specified date and time from our premises

2.2 Payment Terms

Payment terms are as follows:

• Full payment is required at the time of order placement unless otherwise agreed
• We accept payment via bank transfer/PayID as specified
• Orders are not confirmed until payment is received and verified
• All prices are in Australian Dollars (AUD) unless otherwise stated

2.3 Pricing

All prices displayed on our website are subject to change without notice. The price confirmed at the time of order placement is the final price. Custom orders may require additional charges for special designs, decorations, or rush orders.

3. Product Information and Customisation

3.1 Product Descriptions

We strive to provide accurate descriptions and images of our products. However, actual products may vary slightly in appearance due to the handmade nature of our items and variations in ingredients, colours, and decorations.

3.2 Custom Orders

For custom orders:

• Please provide detailed specifications and any reference images at the time of ordering
• We will do our best to match your requirements, but exact replication may not always be possible
• Complex custom designs may require additional time and may incur extra charges
• Any changes to custom orders must be requested at least 72 hours before the scheduled pickup date

3.3 Allergen Information

While we take care to accommodate dietary requirements, our products are prepared in a kitchen that may handle allergens, including nuts, dairy, eggs, gluten, and other common allergens. Customers with severe allergies should inform us at the time of ordering. We cannot guarantee a completely allergen-free preparation and accept no liability for allergic reactions.

4. Pickup and Delivery

4.1 Pickup

Orders are available for pickup at the location specified at the time of ordering. You are responsible for collecting your order on the agreed date and time. Orders not collected within 24 hours of the scheduled pickup time may be disposed of, and no refund will be provided.

4.3 Storage and Handling

Our products are best consumed fresh. You are responsible for the proper storage and handling of products after pickup or delivery. We are not liable for any deterioration in quality due to improper storage or handling after the product leaves our premises.

5. Cancellations and Refunds

5.1 Cancellation by Customer

Cancellation terms:

• Cancellations must be requested at least 72 hours before the scheduled pickup date
• Cancellations made 72 hours or more in advance may be eligible for a full credit and can be used for another order.
• Cancellations made less than 72 hours before the scheduled date may incur a 50% cancellation fee
• No refunds will be provided for orders cancelled within 48 hours of the pickup date & Time

5.2 Cancellation by Treat With a Cake

We reserve the right to cancel orders due to circumstances beyond our control, including but not limited to ingredient unavailability, equipment failure, or health and safety concerns. In such cases, a full refund will be provided.

5.3 Refunds

Refunds, when applicable, will be processed using the same payment method used for the original order. Processing may take 5-10 business days. Refunds are not available for products that have been collected or delivered, except in cases of significant quality issues reported within 24 hours of receipt.

6. Quality and Complaints

We take pride in the quality of our products. If you have any concerns about your order, please contact us within 24 hours of pickup or delivery. We will investigate all complaints and offer a resolution.

Complaints must be accompanied by photographs where applicable, and we reserve the right to inspect the product before processing any claim.

7. Intellectual Property

All content on our website, including images, text, logos, and designs, is the property of Treat With a Cake and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without our written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Treat With a Cake shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services or products.

Our total liability for any claim arising from these terms or our services shall not exceed the amount paid by you for the specific order in question.
